Proposal for a Regulation for the free flow of non-personal data in the European Union

The free flow of data is considered a pre-condition for a competitive data economy within the Digital Single Market. In this regard, on the 13th of September 2017, the European Commission has proposed a Regulation aimed at removing obstacles to the free movement of non-personal data.
This Regulation, together with the General Data Protection Regulation, follows the objective to ensure a comprehensive and coherent approach to the free movement of data in the EU.
In particular, it aims to:
  • reduce the number and range of data localisation restrictions;
  • enhance legal certainty;
  • facilitate cross-border availability of data for regulatory control purposes;
  • improve the conditions under which users can switch data storage and/or processing service providers or port their data back to their own IT systems;
